I am having trademark issues with my brand, my initial application was knocked back and I have had some bad experiences with IP lawyers I own a brand called Glimmr (No "e" between the 'm' and 'r') My recent trademark application was knocked back, unfortunately. The below are the reasons; ¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨¨ 1881791: GLIMMERSTICKS for cosmetics, namely eye coloring pencils, eye lining pencils, lip colouring pencils, lip lining pencils, and eyebrow pencils; 2297854: GLIMMER for non-medicated grooming preparations for dogs, namely, dog shampoo, dog coat grooming chalk, and dog coat finishing spray; 2846711: GLIMMER BRONZE (with “BRONZE” disclaimed) for cosmetics, namely face shimmer powder and body shimmer powder. My trademark application was as followed: 1. Your mark. GLIMMR (Standard Characters, mark.jpg) The literal element of the mark consists of GLIMMR. The mark consists of standard characters, without claim to any particular font style, size, or color. 2. Your serial number. Your application was assigned serial number '88473514'. You must refer to your serial number in all communications about your application. International Class 003: Beauty masks; Cosmetics; Hair colouring and dyes; Hair gel and hair mousse; Hair masks; Hair spray; Hair tonic; Hair wax; Oils for hair conditioning; Skin and body topical lotions, creams and oils for cosmetic use; Sun-tanning oils and lotions; Sunscreen creams; Suntan creams; Dry shampoos; Hair shampoo; Pet shampoos Intent to Use: The applicant has a bona fide intention, and is entitled, to use the mark in commerce on or in connection with the identified goods/services. (15 U.S.C. Section 1051(b)). International Class 021: Hairbrushes; Hair combs; Electric hair combs Intent to Use: The applicant has a bona fide intention, and is entitled, to use the mark in commerce on or in connection with the identified goods/services. (15 U.S.C. Section 1051(b)). I was told, "The chances of all three refusals being withdrawn are slim". What is the best way around this? I was thinking of adding an icon to the logo of some sort. For examples please search "Glossier logo icon" on google and you will see a "G" that is a little abstract with the word glossier underneath. I need to organise this application as soon as possible.
Depends on why you are getting refused. What is it that makes them refuse your product? Maybe look into that and try correcting the issues! Good luck!
